July's Final Friday's Webinar

Please join us for APA's latest "Final Friday's" webinar on Friday, July 25, 2014, from 3:00 to 4:00 p.m. EDT, which will cover a review of Riley v. California and other significant criminal cases from the latest term of the United States Supreme Court. Though relatively few in number this term, these cases decide some important issues that all criminal justice practitioners should be aware of.  We will also take a look ahead to cases of interest that have already been granted cert and may be decided in the next term.  APA is seeking one credit of Continuing Legal Education credit from the State of Virginia for this webinar and can help attorney attendees qualify this webinar for CLE credit in their own jurisdictions. **Please click HERE to register.**

DA's office awarded No Refusal Initiative grant

Harris County District Attorney Devon Anderson announced today that her office has been awarded nearly a half a million dollars in funding for the No Refusal Initiative. The funding is provided by the Texas Department of Transportation by way of a federal grant.  Under the No Refusal Initiative, extra prosecutors are assigned to help law enforcement obtain a search warrant to draw the blood of any suspected intoxicated driver who refuses to take a Breathalyzer test or to give a blood sample. In April 2013, the Harris County District Attorney’s Office became one of the first district attorney’s offices in this region to enact a no refusal policy every day.

NYPD Orders New Training in Use of Force

Every New York Police Department officer will be retrained in the use of force following the death of a Staten Island man after an officer subdued him with an apparent chokehold, Commissioner William Bratton said Tuesday.  The "top-to-bottom" retraining of nation's largest police force, with 35,000 officers, is an undertaking that could take years, Mr. Bratton said.  Thursday's death of 43-year-old Eric Garner raised new questions from elected officials and civil-rights leaders about police brutality. The NYPD prohibits the use of chokeholds.  "As I have reviewed that incident and reviewed the training of the department, it is my belief that we are going to have to do more than just a review of Staten Island," Mr. Bratton said at a news conference at police headquarters.

Northampton County district attorney warns litigants not to lie in courts

Northampton County District Attorney John Morganelli is warning the public not to give false testimony in court after a rash of incidents in the past six months. In a news conference this afternoon, Morganelli said there have been several cases of falsifying records and lying in court in a handful of civil cases. Most cases resulted in charges being filed, he said. "These matters are serious and there appears to be a trend," Morganelli said. "For some reason, people believe that they can supply false information to our courts, give false testimony to our judges and get away with it."
